TERMS OF SERVICE

These Terms of Service (“Terms”) govern access to walltheart.com and purchases from **KAYRA HOME**, trading as **WallTheArt**. By using the website or placing an order, you agree to these Terms. If you do not agree, do not use the services.

Mandatory consumer rights in your country or state are not excluded or limited by these Terms.

## 1. Eligibility and Accounts

You must be legally capable of entering into a binding contract. If you use the website on behalf of an organization, you represent that you have authority to bind it. You must provide accurate, current information and keep account credentials secure. We may suspend access where reasonably necessary to protect customers, the website, or legal compliance.

## 2. Our Works and Product Categories

WallTheArt offers Original Works, textile-based artworks, Gallery Editions, canvas and glass editions, and related services. Product-specific descriptions, dimensions, materials, availability, and care information form part of the offer.

“Original Work” identifies a work offered by WallTheArt as a unique physical composition according to the product record. It does not imply independent third-party authentication, a particular art-market accreditation, or a certificate from an external authority unless the product page expressly states otherwise.

An “Individual Artwork Record” is WallTheArt’s descriptive commercial record of available information such as dimensions, materials, technique, condition, and catalogue number. It is not an independent appraisal, title opinion, provenance guarantee, cultural-property clearance, or third-party certificate.

Signatures, artist documentation, certificates, editions, and provenance are included only when expressly identified on the applicable product page or order confirmation.

## 3. Handmade Variation and Display

Handmade and textile-based works may show variations in color, pile, weave, texture, repaired areas, edges, joins, pigment, dimensions, and surface irregularity. These may be inherent or intentional characteristics rather than defects.

Screens, lighting, photography, and browser settings can affect perceived color and scale. We take reasonable care with product imagery, but cannot guarantee that a display reproduces every tonal or textural detail exactly. Dimensions are approximate within reasonable handmade tolerances unless stated otherwise.

## 4. Product Information and Availability

We aim to keep descriptions and availability accurate. A product appearing online is not guaranteed to remain available. Unique works may be removed if sold through another authorized channel before inventory synchronizes. If we cannot fulfill an accepted order, we will notify you and issue an appropriate refund.

Archive or “Sold” pages may remain publicly visible for catalogue and editorial purposes but do not indicate current availability.

## 5. Orders and Contract Formation

Submitting an order is an offer to purchase. An automated acknowledgement confirms receipt but does not necessarily constitute acceptance. A binding sales contract is formed when we send an acceptance or dispatch confirmation, or otherwise expressly confirm the order.

We may decline or cancel an order for legitimate reasons, including unavailability, pricing or description error, suspected fraud, payment failure, sanctions or export restrictions, delivery limitations, or misuse of a promotion. If payment has been captured for a cancelled order, we will refund it.

## 6. Prices, Taxes, and Payment

Prices are shown in the selected currency and may change without notice before an order is submitted. Taxes, delivery charges, duties, and other fees are displayed or described at checkout where technically available.

International orders may be shipped on a duties-unpaid basis unless checkout or the order confirmation expressly states that import duties and taxes are included. The recipient may be the importer of record and responsible for destination-country charges.

Payment is processed through Shopify and authorized payment providers. You represent that you are authorized to use the selected payment method. Installment products, including Shop Pay Installments, are provided under the payment provider’s separate eligibility requirements and terms.

## 7. Commissions and Personalized Orders

A commission or personalized order is governed by the written specifications, price, deposit, approval process, estimated schedule, cancellation terms, and permitted revisions confirmed for that project. Work may not begin until required payment and approvals are received.

Customer approvals of dimensions, spelling, layout, color direction, supplied images, and other specifications are binding, subject to mandatory law. Changes after approval may require additional fees and time.

You represent that you own or have permission to use all images, names, text, trademarks, and other material supplied to us. You grant us the limited rights necessary to create and deliver the requested work. You are responsible for claims arising from material you were not authorized to supply.

## 8. Shipping, Delivery, and Risk

Delivery is governed by our Shipping Policy. Estimated dates are not guarantees unless expressly agreed. Where applicable law requires, we will seek your consent to a material delay or provide a cancellation and refund option.

Risk of loss remains with us until the item is delivered to you or your designated recipient, except where applicable law provides otherwise or you independently appoint a carrier not offered by us. Title transfers only after full payment and as permitted by law.

## 9. Returns and Statutory Rights

Returns, cancellations, and refunds are governed by our Return and Refund Policy. Nothing in these Terms limits statutory rights concerning faulty, damaged, unsafe, misdescribed, or non-conforming goods.

## 10. Care, Installation, and Intended Use

Customers are responsible for suitable placement, mounting, and ongoing care. Textile works should generally be protected from persistent moisture, excessive heat, prolonged direct sunlight, abrasion, pests, and unsuitable cleaning products. Large or heavy works should be installed by a competent professional using hardware appropriate for the wall and local conditions.

Product-specific care or installation instructions take priority. We are not responsible for damage caused by improper handling, installation, environmental conditions, unauthorized repair, or failure to follow supplied guidance, to the extent permitted by law.

## 11. Intellectual Property

The website, brand elements, logo, page design, editorial text, product photography, catalogue records, graphics, code, and other content are owned by or licensed to WallTheArt and are protected by applicable intellectual-property laws.

Purchase of a physical work transfers ownership of that physical object after full payment; it does **not** transfer copyright, trademark, reproduction, merchandising, digitization, adaptation, or commercial-use rights unless expressly agreed in writing.

You may not scrape, reproduce, publish, sell, modify, train a commercial model on, or commercially exploit website content without written authorization, except as permitted by mandatory law.

## 12. Acceptable Use

You must not use the website to violate law, infringe rights, transmit malware, interfere with security, access systems without authorization, submit false information, conduct fraudulent transactions, or collect data through automated means contrary to our instructions or applicable law.

## 13. Third-Party Services

The website may use or link to services operated by Shopify, payment providers, carriers, social platforms, or other parties. Those services may have separate terms. We are not responsible for third-party services outside our reasonable control, but this provision does not limit rights you may have against us under mandatory consumer law.

## 14. Disclaimer

To the fullest extent permitted by law, the website and general editorial content are provided on an “as available” basis. Room imagery, placement suggestions, viewing tools, dimensions, and editorial material are for general presentation and do not replace professional structural, installation, conservation, tax, customs, or legal advice.

We do not exclude warranties, guarantees, or remedies that cannot lawfully be excluded.

## 15. Limitation of Liability

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, willful misconduct, breach of mandatory consumer rights, or any liability that cannot legally be limited.

Subject to the preceding sentence and to the fullest extent permitted by law, WallTheArt is not liable for indirect, incidental, special, or consequential loss that was not reasonably foreseeable when the contract was formed. For commercial customers, our aggregate liability arising from a particular order will not exceed the amount paid for that order, except where a higher amount is required by law.

These limitations do not reduce remedies available to consumers under applicable law.

## 16. Indemnity for Business Misuse

If you use the services for business purposes, you agree to indemnify WallTheArt against third-party claims arising from your unlawful use of the website or material you submit without authorization. This clause does not apply to consumers to the extent prohibited by law.

## 17. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules. If you are a consumer, this choice does not deprive you of mandatory protections or forums available under the law of your habitual residence.

Before commencing formal proceedings, please contact **support@walltheart.com** and allow us a reasonable opportunity to resolve the matter. Courts and consumer authorities having mandatory jurisdiction remain available. We do not require consumers to waive a lawful right to collective relief or submit to arbitration through these Terms.

## 18. Changes

We may update these Terms prospectively. The version displayed when an order is placed will generally govern that order, except where a change is required by law or agreed with you.

## 19. Severability and Entire Agreement

If a provision is held unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue. These Terms, the applicable product page, order confirmation, Return and Refund Policy, Shipping Policy, and Privacy Policy form the agreement concerning an online purchase.
